Terms of Service

These Terms of Service (“Terms”) govern your use of the ColdHQ website and services. By purchasing a plan or submitting a contact form, you agree to be bound by these Terms. Please read them carefully.

1. Services

ColdHQ provides done-for-you B2B lead generation services, including verified lead list delivery, AI-written email sequence creation, sending infrastructure setup, and campaign management, as described on our pricing page.

All deliverables, timelines, and scope are as stated on the pricing page at the time of purchase. We reserve the right to update our service offering at any time, with changes applying to new purchases only.

2. Payment Terms

One-time plans (Starter & Launch)

Payment is due in full at the time of purchase. All one-time payments are processed securely through Stripe. You will receive a payment confirmation by email.

Monthly subscription (Growth)

The Growth plan is billed monthly on the date of your first payment. Your subscription renews automatically each month until cancelled. You can cancel at any time — see Section 5.

Taxes

Prices are exclusive of applicable taxes. Where required by law, sales tax, VAT, or GST may be added at checkout.

3. Delivery & Timelines

• Starter plan — lead list delivered as a CSV file within 48 hours of receiving your targeting brief
• Launch plan — lead list, email sequence, and first campaign live within 5 business days of receiving your brief
• Growth plan — fresh leads and a new campaign sequence delivered within the first 5 business days of each billing cycle

Timelines begin once you provide the required targeting information. Delays caused by incomplete or late briefs are not our responsibility.

4. Refund Policy

Due to the nature of our work — manual research, verification, and custom content creation — we do not offer refunds once work has commenced.

If you believe there is a material defect in your delivery (e.g. a significant portion of emails are unverified), contact us within 7 days of delivery at hello@coldhq.co and we will investigate and remedy at our discretion (re-delivery, partial credit, or replacement leads).

We do not guarantee specific results such as reply rates, booked calls, or closed deals. Outcomes depend on many factors outside our control, including your offer, market, and follow-up.

5. Cancellation

You may cancel your Growth subscription at any time by emailing hello@coldhq.co with the subject line “Cancel Subscription”. Cancellations take effect at the end of the current billing period. No partial refunds are issued for unused days in the current cycle.

6. Your Responsibilities

By using our services, you agree that you will:

• Provide accurate targeting information and a legitimate business offer
• Use the leads and email sequences only for lawful B2B outreach in compliance with applicable laws, including CAN-SPAM, GDPR, and CASL
• Not use our services to send spam, harass individuals, or promote illegal products or services
• Not resell, redistribute, or share the lead lists we deliver with third parties without our written consent

We reserve the right to terminate your service without refund if we determine you are using our deliverables in violation of these terms or applicable law.

7. Compliance

We operate our campaigns in accordance with CAN-SPAM (US), GDPR (EU/UK), and CASL (Canada). All campaigns include proper sender identification, a valid physical address, and functional unsubscribe mechanisms. However, you are ultimately responsible for ensuring your use of the leads complies with laws applicable in your jurisdiction.

8. Intellectual Property

Upon full payment, you own the lead lists and email copy we deliver to you. We retain the right to use anonymised campaign data (without identifying your business) to improve our services and benchmark performance.

9. Limitation of Liability

To the maximum extent permitted by law, ColdHQ is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of our services, including lost profits, lost revenue, or lost business opportunities.

Our total liability for any claim arising from these Terms or your use of our services will not exceed the amount you paid us in the 30 days prior to the event giving rise to the claim.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes will be resolved through good-faith negotiation first. If unresolved, disputes will be submitted to binding arbitration or the competent courts in the jurisdiction where Outreach Co. is registered.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on our website at least 14 days before they take effect. Continued use of our services after the effective date constitutes acceptance of the revised Terms.
